SARDAR MUHAMMAD versus SECRETARY TO GOVERNMENT OF PUNJAB, COMMUNICATION AND WORKS DEPARTMENT
Punjab Civil Servants Act 1974 Section 7 (3) Constitution of Pakistan (1973), Article 212 (3) Seniority List given to divisional heads to finalize the classification list as per the date given by the service tribunal. This will result in termination of the service tribunal's validity. The Order of Service Tribunal, however, did not have the effect of seizing the authority of the Head of Department but on the contrary would enable such officer to take appropriate action and finalize it so that the Graduation List could be finalized. The date and direction given to the department was given to the head of the department. His own actions did not predict departmental proceedings on their processing and decision-makers' representations, but only provided deserving relief against the temporary certiorari list but should still be prevented from being finalized. The affected parties either directed them to be disposed of before the service tribunal, or on the basis of a provisional list of advancements in the deputy, the Article Service Tribunal directed questions in respect of the head of the department that the latter had not graduated until the specified date. Prepare the list, in no way will the applicants (public servants) be exposed to the rights of the party. Whose order was directed, however, such an order did not appear to be disturbed; the law of public importance did not include any question that required the attention of the court, denying leave to appeal.
