MUHAMMAD TUFAIL versus THE STATE
Criminal Code of Conduct (CRPC) Section 497 Contempt of Rule (XLV of 1860), Section 302/324/34 Guarantee, Special Court granted the accused on medical grounds for a speedy trial based on Orthopedic Certificate The bail department, Mayo Hospital, Lahore, was called back by the Sessions Court on the basis that it appears that the accused had submitted, there was no material available before the Special Court before the Sessions Court for wrong certification that the said certificate was fake and witnessed it. In a way, dismissing the order of the special court, the sessions court proceeded unlawfully while the accused was taken to the court room. He was asked to walk physically and the process of becoming a doctor / specialist on the above mentioned medical certificate was beyond his jurisdiction and relied on him. Canceling the bail order in favor of Malala, the order of the Sessions Court was found and consequently the accused was released on bail.
