ABDUR RAUF versus MUHAMMAD ASLAM KHAN
Property Act 1882 Section 54 Civil Procedure Code (v. 1908), Section 115 Plaintiff sued his brothers on the basis that his father sold him special property and the defendant (his brother) agreed with the voluntary party. Such transactions were excluded by the courts below on the basis of record evidence. The courts below discussed each issue in detail and gave their victories accurately. Both the courts agreed to arrive at the same decision on the basis of the evidence on record of the question. The fact is that the facts of the sale that led them to know that there was no sale transaction were the plaintiff failed to prove that the lower courts did not exercise jurisdiction over them. Or failed to exercise the jurisdiction contained therein. Or that the plaintiff had no trial on the merits of his jurisdiction, either illegally or materially irregularly, the evidence presented by him regarding the facts of the sale was not affected by the trust. The sale of any vendor for the transaction was not proved. The record decisions and orders of the courts were corroborated by the evidence under which the plaintiff's case was dismissed.
