AHMAD versus MUHAMMAD HAYAT
Prior to the abolition of section 35 of the Punjab Pre-Emission Act, 1991, land was sold before 1975 and a pre-emption case was filed by the plaintiff in June 1975 in connection with the case. Under the Impression Act, 1913, no decree was passed at any stage of the trial before 7 31 198 1986, the trial court dismissed the trial on 11 1 1989, because no one was present at that time. The law was not enforceable, in which case the plaintiff's argument is that under section 35 of the Punjab it can be restored. The Pre-Emission Act 1991 had no power in view of the fact that the provisions of section 35 were not applicable to any case for pre-arrest filed under the Punjab Pre-Impression Act, 1913 before 1986. Section 35 of the Act was applicable. The Punjab Pre-Emission Act, 1913, was declared a denial of the integration of Islam under this case, filed after 31 197 197, but no previous authorization law was enacted.
