MUHAMMAD IKRAM versus MUHAMMAD ASIF
Sindh Tenant Limitation Ordinance 1979 Section 16 invites tenant defenses for alleged non-compliance of the rent controller and submits the rent for the purpose of collecting monthly rent for each tenant under section 16 (1) of the ordinance. The rent was submitted under the approved rent submission order. In addition, the rent for the particular month was submitted on the 15th of the month instead of the 10th of the month. The miscellaneous application was the only field for the tenant's defense to strike the tenant, however, having already submitted the rent for this particular month on the 10th. The orders to evict the tenant were not removed this month as well as the interim order to stop the tenant's defense was set aside and new court remand was obtained after the trial. They were not, however, denied to stop the tenant. Defense of any of the tenants if such tenant has committed a breach of the rental deposit order
