EVACUEE TRUST PROPERTY BOARD versus MUHAMMAD AZAM
The Evakey Trust Properties (Management and Disposal) Act 1975 section 14 was the property under the jurisdiction of the Civil Procedure Code (v. 1908), VII, R11 and Section 9 Constitution of Pakistan (1973), Article 185 (3). The claim was rejected by the trial court because of the lack of jurisdiction by the civil court, but the appellate court rejected it. The trial court was obliged to dismiss the plaintiff because the proceedings in the trial suit were barred by law and that the trial court could not pay any attention to the issue in view of section 9, CPC. And the order to reject his claimant was unimaginable and the orders restored by the appellate court and its validation of the High Court is against the law.
