IQBAL HUSSAIN versus SAHIB KHAN
Special Relief Act 1877 Section 42 Pakistan Mining Concession Rules, 1960, R5 (iii) Civil Procedure Code (v. 1908), Section 115 Declaration of the Right to Minor Book Transfer of Minor Book After the Mining of the Original, Defendant's claim that the defendant in the Minor's transfer was not based on the plaintiff's claim that the trial court in favor of the defendant dismissed the appellate court under the plaintiff's trial, however, the trial did not. The court reversed the decision and dismissed the plaintiff's claim that he was with the manager of the mines. There is no option to transfer the Minor Book and such decision was not presented by the Chief Mining Engineer; the mis-finding made by the appellate court was that the transfer of the Minor Book was issued by an officer. The jurisdiction which was not based on false statements, along with misinterpretation of relevant principles, did not enable the plaintiff to challenge him because he neither raised nor claimed any objection at the relevant time. The transfer of the book by name was claimed by the claimant to be arbitrary, allowing anyone to file an inheritance claim. Take, for any question, on which Minor was transferred to the defendant, was not entitled to acceptance. The fresh and original order of Minor Book Release in favor of the defendant, therefore, cannot be challenged on a technical basis as it issued an appeal court order in favor of the Chief Mining Engineer and the plaintiff instead of the manager of Mines Jamal. Should have done Was set aside and the trial court dismissed the plaintiff's case and reinstated the circumstances
