The Industrial Relations Ordinance 1969 Section 25 Constitution of Pakistan (1973), Article 199 upholds the Labor Appellate Tribunal Labor Court's decision ordering the employment court to dismiss the labor court. The back benefits worker, in the appeal memo, also claimed back benefits and had clearly stated before the Labor Appellate Tribunal that he had been unemployed after his dismissal and had received no money from any source. Earnings simply because the worker did not specify in his statement before Labor that the court said he had been in employment during his term of employment cannot be denied return benefits. Labor forum orders regarding back benefits were set aside and the matter was remanded to the relevant Labor Court to allow the parties to present evidence on the question of back benefits.
