The Special Relief Act 1877 Section 42 Constitution of Pakistan (1973), Article 185 (3) was rejected by all the courts, including the High Court's affirmation, on the assertion that the plaintiff claims to be the owner of the property in question, any documentary or reliable. No oral evidence was ever sought to prove that the legal heritage had ever been privately distributed and that the property which was in possession fell to the share of the plaintiff and the non-competing defendant. The defendant has received a certain amount of rent as separate rent. The property will not proceed to the plaintiff's case, as no deficiency was identified in the High Court decision held by all the courts below.
