Article 53 Constitution of Pakistan (1973), Article 185 (3) of the West Pakistan Land Revenue Act 1967, the defendants denied the claim of possession of a specific khasra number on the basis that the Khasra number is questionable. There is no settlement record in Kishtwar, nor is there any subsequent jamabandi lawful plaintiff's position that the questionable number was allotted to him in the settlement / division proceedings and such entries were made in subsequent jambandis. And that the plaintiff had possession of it. In addition to the Khasra number, the plaintiffs for the special year in the Comprehensive Bond were listed for the first time as non-competent and in the column of deed as "Bel Ada Legan" appeal was taken by the plaintiff on leave of appeal. The dispute was also allowed to be considered. Further this debate is shown in Khasra No. 3954/4. And also to consider whether the High Court correctly examined the evidence on record before recording its decision.
