AMEERAN BIBI versus MUHAMMAD ASHRAFF
Section 24 of the NWFP Pre-Emission Act 1987 [as presented in the North-West Frontier Province Pre-Impression (Amendment) Act (X of 1992]], the trial court upheld its first order which caused confusion before it was discriminated The Jamaat Trial Court itself ordered the confusion to be submitted on the one hand, the required amount to be submitted before the due date and on the other hand within thirty days. Both such directions were different from one another. (Accumulated within thirty days) fell during the holiday month while the other fell. Even if the holiday is beyond the leave period, even if the claimant had deposited the money in question before the due date without considering the directive of thirty days, his deposit would have been legal as it was clearly provided under the order of the plaintiff himself. However, he was well within his rights to dispel the confusion through a subsequent order by which a specific date (for premature deposit) remained by a party to the court itself. It will be condemned because of the confusion that arises, and the court-created confusion was rightly removed. Because of such confusion presented by the court, the defendant did not have any right and had already served his order before the defendant's service. The defendant was never aware of the court's attempt to amend his order, and after that, no right was created in favor of the defendant.
