Failure to hear the accused before directing the registration of the case against him, did not affect any prejudicial decision regarding their rights held in the constitutional petition, and the police officer's report, revealed the case. That was disclosed by the High Court. As such, their exercise of discretion was not practiced illegally while the appeal was dismissed accordingly, directing the accused to file an intra-court appeal.
