MUHAMMAD YAR versus ADDITIONAL COMMISSIONER (CONSOLIDATION)/SETTLEMENT COMMISSIONER, MULTAN
The Constitution of the applicant's cancellation of the allotment was dismissed on the basis of the displaced persons (Land Settlement) Act, 1958, section 14 of Pakistan (1973), Article 185 (3), on the grounds that the informants were excluded. The required parties were not implemented. Under Section 14A, displaced persons under the Land Settlement Act, 1958, have the right to re-secure the allotment of land as a result of their information, in lieu of their claim. If any, they will be an integral part of the constitutional application. Thus, in the absence of information from the informants, the High Court had right in rejecting the constitutional application which was not implemented, which, in fact, had succeeded in securing the land in question on the basis of its confidential application, In the circumstances the leave of appeal was denied
