SUFAIDI versus KANNI
The order of land allotment made to the claimants of sections 10 and 11 of the Homeless Land (Land Settlement) Act 1958 was not specifically challenged by the second heir (petitioner). It was held that the allotment in favor of the defendant (excluding the appellant), although it was found to be unfair but not unapproved in the law as per the law of the Deputy Settlement Commissioner, allowed the claimant's heirs to inherit the land according to the law. Should be given and allotment was in fact a legacy of his and such a question could be settled. Only if the applicant challenged the order of the appellant in response to the question, can it not be held that the defendant is not entitled to inherit the deceased claimant?
