Government Allotment of Land (Punjab) Act 1912 Section 10 Constitution of Pakistan (1973), Article 199 The allotment of land was being leased on an annual basis for temporary cultivation through open auction and the applicant was the most successful bidder. The land, which was then in possession, was transferred to the Irrigation Department and the applicant in front of the department requesting for the grant of an 'objection certificate grant which showed that no further land was required by the department which rejected the request. The petitioner's complaint in the constitutional petition was that the matter should be released to the department. There was no right to insist that the land be handed over to the Revenue Authority in the dispute from which the applicant could buy the same applicant, and the department should hand over the disputed land to the Board of Revenue and issue an NOC. The Department does not require land for their use and occupation.
