SARDAR ALI versus THE STATE
Under Section 561A and 544A (2) of the Penal Code (XLV of 1860), Section 302, Section 561A, the default penalty for payment of Part II petition compensation under CRPC was given to the one year RI. The default accused in payment of compensation of Rs 10,000 to the deceased's legal heirs was contrary to the provisions contained in section 544A (2), CRPC, and was due to a patent error on the face of the record. Can be corrected under 561A, CCPC: Accordingly the verdict was corrected and the accused was ordered to suffer for six months.
