JEHANDAD versus THE STATE
Examining the accused sections 326 and 452 of the Criminal Code (V9 1898), Sections 342 and 364, some questions were put before the accused in the nature of cross-examination and some controversial circumstances were excluded in their examination under section 342, CR PC needs its latest exam. In light of the court record, the trial court also did not comply with Section 6464, CRPC Express and the mandatory provisions as neither the accused's signature was obtained on his statement filed under Section 222, CRPC. Nor was the certificate itself contained in his written document. The accused was examined in his presence and hearing, and that this record is a complete and accurate calculation of the statement made by him on the ground that there was no instability on any score and it was not a technical error. Or the irregularity that distorted the trial and the decision was pronounced in this case. As a result, the conviction and sentence of the accused were set aside and the case was re-sent to the trial court.
