The Civil Procedure Code Order XLVII, O XLVII, Rr l & 5 Division Bench of the CPC Review Section 114 hearing the constitutional petition for review and decision was made by the Division Bench of the High Court, consisting of two judges One of the parties was included in the Supreme Court. Reviewing the final decision of the said Division Bench, but as one of the judges of that Bench was elevated to the Supreme Court, the office gave the Chief Justice a reference to whether the present Single Judge should place a review petition before the Chief Justice. On reference, the order passed that the review petition be presented to the second Bin Qazi court judge for hearing and disposition, stating that the review petition was to be heard by the Division Bench against the decision of the Division Bench consisting of two judges. Not a single judge held when one of the judges, after a final verdict, was available at such time. A review petition was filed against your decision and appeared for a hearing and other gambling by DGs or judges who had heard / were not available in the case, looking at any of the judges who might be available. The Secondary Court shall hear the petition and no other judge or court judge shall hear the same constitutional petition which was decided by the Division Bench of the Civil Division. The constitutional petition did not exempt the CPC's provisions relating to its review, but they will apply for a review of the petition filed in the constitutional petition at which a bench judge's review petition was heard.
