SHAMSHAD AHMAD QURESHI versus THE STATE
The magistrate did not comply with the provisions of sections 5 and 6 of the Sindh Crimes Control Act, 1975, for the removal of sections 14, 5 and 6 of the Criminal Code (v. 1898), because the magistrates could not agree on the police report. Only the tribunal could take action against it. In all four cases mentioned in the Police Act, the accused was acquitted; thus, continuing the proceedings against the accused, thereby amounting to misuse of the court proceedings and accordingly he was terminated.
