YOUSUF versus THE STATE
Criminal Code of Conduct (CRPC) Sections 107/117/112 & 561 Termination of proceedings Neither the complainant mentioned any date or time of the alleged proceedings by the applicant, Nor does it pose any threat to any breach of the peace. The aforesaid proceedings are shown in which witnesses examined during the preliminary investigation through trial. The magistrate did not contribute to the complainant's statement. The allegations made in the complaint were vague and public in nature and the complainant did not even contact the police station for his rectification. Complaint 5 107 or section 117 was not an issue under CRPC and the order issued by the magistrate under section 1112, CCPC could not be retained, based on the direct complaint filed by the complainant. The continuation of the proceedings could not be sustained, therefore, its misconduct was dismissed accordingly.
