KARIM KHAN versus ADDITIONAL SETTLEMENT COMMISSIONER (LAND)
The Central Record Office's accuracy report on the eviction of vacancies and the Homeless Act (repealed) Act 1975 section 2 (2) Constitution of Pakistan (1973), Article 185, on the basis of an open request clearly stated this. It is confirmed that the Certified Claim Appellant was the original predecessor (the original Allottee), a genuine Additional Settlement Commissioner who canceled the allotment because of a misunderstanding as to the nature of the original Allies entitlement. There was no settlement of the claim or the notice was taken by the Additional Settlement Commissioner. If he had carefully reviewed any of the surrounding facts, the Additional Settlement Commissioner merely took note of the informant's objection and did not make any proper investigation to confirm the correct position. If he had done so, he would have known that the claim of the original allottee was in fact validated by the order of the Additional Settlement Commissioner, under which he canceled the allotment made in favor of the original allottee. As such, the High Court's decision refused to set aside such. The wrong order was set aside
