Revision was not supported against the trial court's decision on section 302/34 Criminal Code (v. 1898), section 439, as the principle of non-interference was invoked under the impugned order. There was enough material on the record to cause a miscarriage of justice on the basis of ridiculous and illogical reasoning that the accused and no one else were the assailants in the incident, medical evidence, blood stained in the hands of the accused. The fact that the injured were close to the close of the injured, except in all likelihood of false execution, was a strong case of jealousy, in which the judge's decision to acquit the accused was set aside and the trial re-opened. The session was remanded to court.
