In the Punjab Local Government Ordinance 1979, the selection of 21 unqualified returning candidates and candidates was challenged on the ground that it was a contractor in the Local Council, to show that it was ineligible to contest the election. There was nothing in the record that showed the candidate had any interest or interest in it. On the day of the nomination with the Union Council, the performance of any contract was neither material on the record nor was it alleged to show that the returning candidate at the relevant time stated that the Union Council was a contractor of such. In the absence of evidence, it cannot be said that the back candidate was disqualified to be a candidate or member of the aforesaid Union Council.
