Sections 15, 16 and 30 of the Punjab Pre-Emission Act, 1913, with respect to immovable property were not already passed before the due date set in the Syed Kamal Shah case of 31 198 1986 (PLD 1986) SC 360) Consequently, the provisions of the Punjab Pre-Emergency Act, 1913 have been declared inappropriate on the basis of which no case can be proceeded, except after the judgment of the court after 31 July 1986, the order of the suit. The Prediction of the Case, (PLD 1986 SC) imm 360) was also applicable in connection with a pre-emption suit relating to immovable property which will be ordered for the first time on June 26, 1988. That is, such a decision was not lasting because of the pre-emption of the Punjab Pre-emption Act, 1913, therefore, was not available after the date of 31st 1986.
