Examining the Pakistan Penal Code Section 121 evidence, the trial court had given the wrong view that the letter authorizing the sanction could be considered as a complaint itself, as there was a difference in the sanction and the complaint even in the letter mentioned above. There was no mention of any kind of permission. Penalty punishable under Section 121A, PPC: Section 196, CCP was allowed to file a complaint in the case, CCPC was illegal and there was no cure for irregularities under section 37 under37, , The PC Trial Court, had no jurisdiction to proceed to the trial. Which was not in accordance with the law even otherwise there was evidence to hear the evidence presented by the prosecution against the accused
