Section 16 (1) (2) invokes the tenant's defense, instead of submitting the rent in the name of the landlord in compliance with the rental order approved by the tenant controller, an issue issued in the name of the rent submission. The wrong person, though the tenant, did not have any uncertainty in mind that he had to be rescued as a tenant in order to find out the real landlord / landlord who was occupied and to collect the rent in the name of the wrong person.
