FARHAT YASMEEN versus SHAHEEN AKHTAR
The first order of the Arts 199 High Court was not complied with, in which the court directed that both the applicant and the respondents be adjusted at their homes by posting on or before the due date. The transfer orders were withdrawn due to which a complaint was filed with the applicant. The transfer orders were not challenged by the constitutional application. However, the earlier orders directing the transfer near the homes of the High Court applicants and respondents were not complied with, the present constitutional petition should not be dismissed immediately, but the same would be dealt with by the High Court. Should, as has been done before, but at the same time, it is made clear to the parties as well as to the department that such exercise should not be allowed in the future for the simple reason that the service matter. As such, the transfer order cannot be canceled by constitutional route. Application
