During the proceedings of the Pakistan Penal Code Section 302/148/149 case, dissatisfaction with the police investigation of the innocence of only three other accused against the two accused in the challan case, a regular complaint was brought which led to the five accused. The inquiry report, the magistrate's report, was not based on the evidence of the inquiry magistrate, but was based on some personal information collected by him, which was otherwise through evidence that he was not ordered to dismiss the complaint. Therefore, the direction of the trial of the five accused involved was set aside, in which the challan case was directed to remain inactive till the decision of the complaint.
