JAVED IQBAL versus ZILA COUNCIL, SIALKOT
Punjab Local Government Ordinance 1979 Sections 156 and 157 of Pakistan (1973), Article 1998 were set aside by auction of lease by the District Council for collecting tax on the transfer of immovable property in favor of the applicant. Under the Commissioner's Order of the Commissioner was challenged on the ground that only the Government can exercise the powers to terminate the District Council proceedings and the powers which were not given to the Commissioner were ordered to decide the auction for the applicant. , An illegal constitutional petition was filed to consider the question of whether the commission in the absence of a delegation S power to order a separate auction, could be accepted by them and the order was suspended by the Commissioner if the applicant does not comply with the terms of the agreement and bank guarantee offer.
