EJAZ M. KHAN versus MANAGING DIRECTOR, PAKISTAN INTERNATIONAL AIRLINES CORPORATION, KARACHI
Section 10 Service Tribunals Act (LXX of 1973), Section 4 Employee demanding acceptance of the employee's resignation resigns in such a manner that he may resign from the job in the event that disciplinary action can be taken against him. Due to this, employees may be forced to retire. A responsible position could have been resisted, if he had resigned and called for his resignation, even if the employee's version believed that he had been given the option to withdraw from the job or to tender his resignation. But this cannot be a matter of hardship or repression. Instead of being given the appropriate opportunity after he personally testified at the hearing, the proposed punishment for resigning from his job and resigning from his job, however, is no proof of this. The record was not brought in to prove that the employee was either compelled or forced to resign. The employee was not entitled to any relief.
