AHMAD HUSSAIN SHAH versus MA. RAZZA
The Patent and Designs Act 1911 Section 36 Civil Procedure Code (V 1908), O XXXX, Rr 1 and 2 prohibits prohibited persons from manufacturing, importing, selling, storing or marketing drug paraphernalia for a drug patent infringement. The petitioner submitted an affidavit to the manager of his laboratory's analysis department that the defendants were in fact selling the same drug in the market for which the plaintiffs had patents. That their medicine was manufactured by something other than the process itself. Plaintiffs holding the patent had established the first such contention that the defendants were using drugs to manufacture the drug for which the plaintiff holds the patent, thus the ruling is entitled to a restraint.
