MUNAWAR KHAN versus SPEAKER, N.W.F.P. PROVINCIAL ASSEMBLY
Two members of the Provincial Assembly, belonging to a political party belonging to the Constitution of Pakistan 1973 Article 64 Article 127, allegedly did not vote for the nominees for the Senate through the party party that allegedly elected the Provincial. Blank papers were obtained from all their members to be present. The Assembly incorporated the resignation of the two members on the relevant blank papers and accused the Speaker Assembly that the two members had violated party discipline. The two members were allegedly sent to the Speaker through their newspapers. Come to know about the alleged resignations. The Assembly verbally informed him as well as in writing that he had not resigned from the membership of the Assembly and any resignation presented to him by any quarter was fake, fraudulent and based on the ultimate motive. The speaker allegedly assured the members that they would not do so. In principle take any action against the two members, the resignation is mandatory if he wants to resign from the speaker's membership then he should be personally presented to him, if he wants to resign from the speaker's membership. Has also given a statement to the press, assuring that it will not force these members to resign. He had refused the Secretary of the Provincial Assembly despite such a post, yet issued two notifications that the two members had resigned from their seats in the Assembly, and therefore their seats were vacated and his position was vacated.
