F.W. WOOLWORTH COMPANY versus ASSISTANT REGISTRAR -OF TRADE MARKS
Trademarks Registration of Trademarks Act 1940 Sections 6 and 10 Registration of the word woolko as a trade mark with respect to textile and textile goods is not included in other classes. The bed and the table covered everything contained in Class 24, so it was ruled that the word woolko represents a minor change of wool, and there was no significant difference and thus this section of the Act 6 (1) (c) is against the provisions. An attempt was made to register the word Vulco as a trademark, which was an invention used by the applicants themselves. Although the English word wool was a suggestive reference, it did not have a direct reference to the quality of the goods it represented.
