MUHAMMAD RAFIQUE KHAN versus PROVINCE OF PUNJAB.
The reference to the jurisdiction of the Land Acquisition Act 1894 Section 18 Reference Court could not be withdrawn from the reference and the jurisdiction could not be obtained to determine it, especially with regard to such questions only. The reference is referred to the court, therefore, there was no jurisdiction to determine the limitation question. This type of work was within the collector's domain that sent the reference. Reference Court funding that a request for reference filed by one of the owners' claimants was withheld from time to time without complete jurisdiction and the finding was not sustained that such an employer did not file a claimant appeal. Was done and to no avail, such owner had filed cross-objections; according to law it could be dealt with. The court had sufficient authority to give relief to the party who had not filed an appeal. Nor did he cross any objection.
