Under the Trademarks Act 1940 section 73 trademark CRAVEN \ A under the Cigarette Manufacturer and Cigarette Seller trademark infringement case, the defendants were producing and selling cigarettes under the trademark `Caravan '. The plaintiff claimed that the packets in which the defendants were selling cigarettes. The matching packet in which the plaintiff was packing their cigarettes and thus the defendants are likely to deceive the public. There was a clear difference between the packets of both parties, namely on the cigarette packet produced by the plaintiff's letter by A by CRAVEN. While the caravan was mentioned in the defendant's word packets with the asterisk below it, the word filter containing the ket packet that did not happen on the defendant's packet was mentioned on both packets. The printed price was also different. Other related marks were also displayed on the respective packets. Thus, there was considerable difference between the two packets. No part of the public was likely to be duped. D, by the Plaintiffs used by the plaintiffs. Thus, there is no case of interference with the packets that the defendants sell, no trades of merchants by the plaintiffs. Not infringed.
