HUSSAIN AHMED versus STATE
Illegal Arms Ordinance (XX of 1991) Referring to Section 497, Section 7 (1) of the West Pakistan Arms Ordinance (XX of 1965), Sections 13D and 13 of the Bail Ordinance of 1991 are canceled. Section 11D of the Arms Ordinance, 1965, under 2 11 1991 was specifically heard by the special courts that were formed under the Suppression of Terrorist Activities (Special Courts) Act 1975, therefore, no jurisdiction to prosecute. There was no option because there was no request for bail. Having been thoroughly dealt with by the special court, the accused was instructed to obtain his remedy before the special court bail application before the High Court after disqualification at this stage.
