Under the property, it was not transferable to any other person and as such transfer in favor of the respondents was illegal, the applicant was required to be a refugee belonging to the state of Jammu and Kashmir. Cannot be removed there after confirmation of transfer. For a contentious fact between the parties, its final determination required a fact-finding inquiry, whereby the applicant filed a petition by the applicant against the orders made under the West Pakistan Citizen Rental Ordinance, 1959.
