MUBARIK BANO versus GHAFFAR KHAN
Sections 91 and 92 of the Property Act 1882 constitution of Pakistan (1973), Article 185 (3) mortgage suit entered into possession of the property by the mortgagee through the mortgagee acquired the property under question In the case of mortgages, the claim was based on the acquisition of a share of the property so as to widen the scope of the dispute between the parties and prolong the proceedings. The position adopted by the mortgagee in the suit contradicts what he had previously sued for which led to his termination. For the plaintiff's death, another claimant, Mortgagor, even if he was not the sole proprietor, had the right to transfer from her and his mortgage to get rid of the mortgage because they were the persons who were at the time. 9191, was interested in mortgaged property under the meaning of the transfer. Property Act, 1882 Any other person claiming a share in this property may enforce his claim under Section 92, Transfer of Property Act, 1882. The Accord was completely inadequate to record that the mortgagee was not the sole owner of the home or that other respondents were involved. Such matters should have been left to independent proceedings where their claims could be investigated. At length, the High Court erred in interfering with the decisions of the courts below which the preliminary injunction for mortgage recovery was properly approved, amending the preliminary injunction and rescinding the portion of the property that was available. The trial court's decision to grant permission was reinstated.
