MUHAMMAD SABIR versus MUSHARRAF ALI
Sindh Rented Premises Ordinance 1979 Section 15 Constitution of Pakistan (1973), Article 185 (3) for the tenant controller dismissing the tenant High Court on appeal if he is not satisfied with the irresponsibility or personal need of the landlord. Refused to order. Finding a tenant to evict the tenant while keeping the landlord's personal needs and evict the tenant was not attended to the eviction tenant's request based on the tenant's personal need. No notice was sent to the landlord. The tenant contended that the High Court had taken a very technical matter in keeping with the personal need of the landlord and ordering eviction, a view of the matter which was not valid in the eviction proceedings and at least upon notice. The landlord should have received, even after hearing the plea before the tenants in the High Court that the landlord had taken, that the landlord had failed before the rent controller and for the first time changed by an unknown order. The verdict was recorded but in the circumstances the leave of appeal was granted
