In considering the leave to appeal Article 5 Constitution of Pakistan (1973), Art 185 (3), it was granted that the applicant for agricultural land suitable for construction of residential houses was exempted under Section 5 (c) of the Act. In addition to the fact that he was the owner of the land that benefited from the said area, on the basis of the defendant's bail suit filed by the defendants.
