MUHAMMAD SHAFIQ KHAN versus SETTLEMENT COMMISSIONER(LAND)
Para 3 Constitution of Pakistan (1973), allotment of land in lieu of Article 199 certified claim, some part of the land deemed to be excessive entitlement was canceled on the basis of a solicitation petition, no more entitlement land was granted to the applicants. This was done on the basis of fraud or misrepresentation but due to misunderstandings made by the Settlement Officer who passed the Mukhtar Authority's Allotment Order Order which could not be sustained in Mukhtar's favor. As per Para 3, the Rehabilitation Settlement Scheme 1956 and additional land will be allowed to be maintained against the price by the applicant which is to be determined by the concerned officer.
