The Speedy Trials Ordinance (XXV of 1991) for Sections 302/34 and 324/34 Special Courts, Section 5 (2) of the Special Court case was initially under trial by the Sessions Court as also by the Special Court. The same case could not be moved and the case could be tried. The government did not order such a transfer not to be in the public interest under section 5 (2) of the 1991 Ordinance XXV.
