SALIMA BIBI versus SARDAR KHAN
The Punjab Pre-Emission Act 1913 Section 15 Civil Procedure Code (v. 1908), AXXIII, R 3 The correct settlement agreement, was presented to the appellate court by the vendors, recording the terms and conditions of the agreement between the parties. Before agreeing to decide the appeal, Emperor denied such an agreement, saying he had a dispute with the shopkeeper, and that he had to take his thumb impressions on a blank paper for settlement. Because such a compromise was disputed, the court, on the expense of the evidence, provided the same evidence which was substantially restrained upon them. There was convincing evidence. The shopkeepers did not intend to show that the former Emperor Lady was a voluntary party to the alleged compromise and had put down his thumb impression, under which the court took a wrong view of the record, under which the appellant. The wrong indication was raised to find in favor of the court decision. Was set aside on the basis of compromise
