INAYAT BIBI versus ADDITIONAL SETTLEMENT COMMISSIONER (LANDS)
In this constitutional application, on the basis of the displacement of land allotment order in disputes approved by the Land Allotment Authority (Land Settlement) Act 1958, Sections 10 and 11 of Pakistan (1973), Article 185 (3). It was challenged that the authority was not eligible to cancel the allotment as there was no notification officer, but the High Court, seeking the ground raised by the applicant without any merit, dismissed the applicant, granting the petition bail. I pleaded that the authority's finding that the allotment was fraudulent was not supported. The petition was disputed because the record was not brought before the High Court; the Supreme Court refused such leave to appeal.
