AMIR WEAVING FACTORY versus UNITED BANK LTD
Banking Companies (Recovery of Loans) Ordinance 1979 Section 8 (2) Civil Procedure Code (VS 1908), AXLI, R21 and Section 151 Constitution of Pakistan (1973), Article 185 (2) Approval of Interest to Regulators The court ruled on the plaintiff's case but denied any interest to pay interest after any post. The High Court heard the appeal. The decree did not show any grounds for justifying the Appellate High Court's re-hearing, even if the appeal was allowed to be re-heard, even though Section 8 (2), the compelling force behind the banking companies (debt recovery). Could not reverse this quest in view. The ordinance, 1979, which forced the regulators on a grant of interest to appeal the merit without the High Court's decision, was dismissed under the circumstances.
