MANSOOBA versus STATE
The Pakistan Penal Code Section 12 Constitutional Code (XLV of 1860), Section 377 Constitution of Pakistan (1973), Arts 203 DD and 203G Sessions Court clearly observed that Section 12 of the Ordinance VII of 1979, the facts and circumstances of the case. Applies to which the sessions court of the High Court had exclusive jurisdiction over the matter and the trial by the magistrate could not have been interfered with under the legal sessions court section 439A, CRPC. It was held that the trial should be held under Section 12 of the 1979 Ordinance V11, the High Court could not have intervened unless it had already determined that the sessions court's detection, even otherwise. Ordinance VII of 1979 ignored all other laws and in view of Article 203G, the High Court had no jurisdiction to intervene in such matters, thereby maintaining the order of the High Court under law. Was not as it was under the Constitution and that was to put it aside
