In section 51 of the Property Act 1882, the Eisen Profit and Improvement Act (XI of 1855), Section 2 Constitution of Pakistan (1973), Article 185 (3) the respondents filed a direct appeal against the same decision which was ignored in the present petition. Was investigated and pending; Section 1, 1, Property Transfer Act, 1882 and section 2, Mason's Profit and Improvement Act, 55, in 1855 to examine the conflict of laws provisions of the two constitutions. Therefore, the appeal was allowed, the objection was raised by the respondents. The merits of the present application will also need to be examined as to whether the applicants should not have filed a direct appeal. If the respondents' further objection was that the appeal should be treated as more than a time bar and the impact would have to be scrutinized, the appeal was granted.
