BASHIR versus FATEH MUHAMMAD
The Constitution of Pakistan 1973 Article 185 (3), which was earlier allowed to appeal, raised the same controversy that was involved in the present petition, however, only with the difference that it was related to the title of the land in dispute. The pre-case, while a profession related to it would require the question of occupying the land whether the applicants' success in the first case would react to the present case and in that case the merits of the present case would need to be examined. Appeals were granted leave to investigate such questions
