SHAKAR KHAN versus ABDUL QADIR
Article 135 Pakistan (1973), Article 185 (3) of the West Pakistan Citizen Rental Ordinance 1959, Article 185 (3), removing the tenant's dispute over half-estate, was ordered to evict the tenant from the whole premises. Allowed to consider the dispute is whether the landlord sold half of the property to the tenant under the contract, on the issue of whether the landlord and tenant relationship between the parties was a decision at all. And as a result the rent controller was unable to order the eviction of the tenant without determining the issue. The second question left on the premises as a whole was whether the High Court was justified in rejecting the tenant's explanation in the default matter of only one month, which the rent controller determined, in his discretion. Accepted.
