Provided sufficient opportunity for court attendance, in favor of the plaintiff, the order of the trial court was set aside and directed that the plaintiff be given the opportunity to inspect the said witness. The further question is whether the plaintiff or his lawyer has been barred from giving evidence in support of his case, before he will not consider the matter. The appellate court's order for remand of the appellate court cannot be dismissed in such a way that the plaintiff or his agent can record his statement.
